  • Legislation on the marketing of cashew nuts at the center of an open workshop in Yamoussoukro

    The main objective of this workshop is to discuss with the main leaders of the judiciary in the production areas and Abidjan on the conditions of a good implementation of the applicable texts concerning the marketing of the cashew nut, in order to to enable effective management of cases of crime or conflict during these activities. More specifically, it will - Strengthen the capacities of the judicial authorities of the cashew and Abidjan production areas on the marketing mechanism and the applicable provisions - Identify the difficulties encountered and the constraints in applying the legal provisions and regulation in the field - Raising the legal means to remove these constraints, particularly for effective enforcement of the offenses committed in the context of cashew marketing - Collect from practitioners proposals for improvement of the existing legal framework.

    The Director-General of the Coton-Anacarde Council, Dr Adama Coulibaly recalled that the reform of the cotton and cashew nut sectors undertaken by the State of Côte d'Ivoire in 2013 has enabled the setting up of a new marketing and marketing mechanism. regulation of cotton and cashew industry activities. Through the law n ° 2013-656 of 13 September 2013 which sets the new rules relating to the Marketing of Cotton and Cashew and the Regulation of activities in the cotton and cashew nut sectors. Continuing, he said that under this law, several decrees and orders were made by the Government and constitute the special legal mechanism governing the marketing of cashew products. Anything that has generated a lot of enthusiasm for the marketing activities of actors and structures, both inside and outside the country. '' However, noted Adam Coulibaly, '' this craze is not without incidents on the ground. Also, it is often noted cases of violation of the law, the lack of practical provisions and conflicts between the actors or between actors and their partners. During the successive marketing campaigns, difficulties have sometimes arisen in the management of these infringement cases and conflicts between the actors due to the lack of knowledge of the applicable texts on the subject by the actors or certain administrations on the subject. field, or inadequacies specific to these texts ''.

    To give more confidence to the players and to attract national and international economic partners towards this sector, it is essential that the judicial authorities, key actors in the device of creation of a climate of confidence and an environment conducive to a healthy competition between economic agents, have a good knowledge and understanding of the cashew marketing mechanism. Hence the meaning of this Yamoussoukro Workshop.

    "The work that has opened in Yamoussoukro and that will last for two, should help to harmonize our understanding and knowledge on the cashew marketing mechanism. It will allow you to exchange with the main judicial leaders that you are, on the conditions of a good implementation of the texts applicable to the marketing of the cashew nut, in order to allow an effective management of the cases infringement or conflict, 'said the Director-General of the Coton-Anacarde Council.

    This workshop will be an opportunity for the Cotton and Cashew Council to communicate on the commercialization scheme, the procedures and documents for the marketing of cashew nuts, and on the other hand to collect the suggestions of practitioners, particularly with regard to repressive measures.

    Having recalled that this Workshop is part of the implementation of the reform of the cotton and cashew nut sector and especially that of the permanent reflection with a view to making adjustments to the provisions of this reform for greater efficiency, Bamba Mamadou, President of the Board of Directors of the Coton Aardarde Council, paid tribute to the President of the Republic Alassane Ouattara and Prime Minister Amadou Gon Coulibaly for their constant support for the development of the cotton and cashew nut sectors.

    In addition to the magistrates, representatives of the General Secretariat of the Government, the Ministry of Justice, the Ministry of Agriculture and Rural Development, in particular the Directorate of Legal Affairs, Litigation and Cooperation, are taking part in this Workshop. members from the National Institute of Judicial Training.

    The reform of the cotton and cashew nut sectors undertaken by the State of Côte d'Ivoire in 2013 allowed for the establishment of a new marketing and regulation mechanism for the cotton and cashew value chain activities. Law No. 2013-656, promulgated on 13 September 2013, sets the new rules for the marketing of cotton and cashew nuts and for regulating activities in the cotton and cashew nut sectors. In application of this law, several decrees and orders have been issued by the Government and constitute the special legal framework governing the marketing of cashew products.
